font-size: 14px; text-align: justify;\"><span style=\"line-height: 115%;\">Cuenca.-<\/span><\/b><span style=\"font-family: arial, helvetica, sans-serif; font-size: 14px; text-align: justify; line-height: 115%;\"> El juez segundo de garant\u00edas penales de Azuay, Sim\u00f3n Valdiviezo Vintimilla, dict\u00f3 prisi\u00f3n preventiva contra del ciudadano M.G.D.T., quien presuntamente habr\u00eda cazado a un c\u00f3ndor en los p\u00e1ramos de la provincia de Azuay.<\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"line-height: 115%;\">La decisi\u00f3n la adopt\u00f3 en base a los elementos de convicci\u00f3n presentados por la fiscal Roc\u00edo Polo durante la audiencia de formulaci\u00f3n de cargos, quien lo acus\u00f3 por atentar contra la flora y fauna, espec\u00edficamente, en lo referente a animales en peligro de extinci\u00f3n.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"line-height: 115%;\">Entre los elementos est\u00e1n las versiones de seis comuneros del Agua de Riego de Gualay (Azuay) que se tomaron la foto, \u00a0que circul\u00f3 en las redes sociales, con el ahora procesado quien, en la actualidad, est\u00e1 pr\u00f3fugo. <\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"line-height: 115%;\">De esta manera inicia la etapa de instrucci\u00f3n fiscal que durar\u00e1 90 d\u00edas. <\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\">El hecho se conoci\u00f3 el s\u00e1bado 27 de abril del 2013, cuando a trav\u00e9s de la red social \u201cFacebook\u201d, circul\u00f3 una fotograf\u00eda del ave sin vida, en manos de dos personas que le sujetaban las alas, mientras una tercera tomaba de su cuello. <\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\">Con este antecedente, el lunes 29 de abril, la direcci\u00f3n del Ministerio del Ambiente en Azuay present\u00f3 la respectiva denuncia en la Fiscal\u00eda de esta provincia resaltando que \u00e9sta es una especie en peligro de extinci\u00f3n. <\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><b>Datos:<\/b><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"line-height: 115%;\">La infracci\u00f3n que se investiga est\u00e1 tipificada en el Art. 437, literal F del C\u00f3digo Penal: \u201cEl que cace, capture, recolecte, extraiga o comercialice, especies de flora o fauna que est\u00e9n legalmente protegidas, contraviniendo las disposiciones legales y reglamentarias sobre la materia, ser\u00e1 reprimido con prisi\u00f3n de uno a tres a\u00f1os.<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"line-height: 115%;\">La pena ser\u00e1 de prisi\u00f3n de dos a cuatro a\u00f1os cuando:<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"line-height: 115%;\">a) El hecho se cometa en per\u00edodo de producci\u00f3n de semilla o de reproducci\u00f3n o crecimiento de las especies;<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"line-height: 115%;\">b) El hecho se cometa contra especies en peligro de extinci\u00f3n; o,<\/span><\/span><\/span><\/p>\n<p style=\"text-align: justify;\"><span style=\"font-size: 14px;\"><span style=\"font-family: arial, helvetica, sans-serif;\"><span style=\"line-height: 115%;\">c) El hecho se cometa mediante el uso de explosivos, sustancias t\u00f3xicas, inflamables o radiactivas.<\/span><\/span><\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Cuenca.- El juez segundo de garant\u00edas penales de Azuay, Sim\u00f3n Valdiviezo Vintimilla, dict\u00f3 prisi\u00f3n preventiva contra del ciudadano M.G.D.T., quien presuntamente habr\u00eda cazado a un c\u00f3ndor en los p\u00e1ramos de la provincia de Azuay.
